Terms of Service

By accessing or using 911 Analytics (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is provided by Taylor Made Designs, LLC ("we," "us," or "our"), an Indiana limited liability company.
1. Eligibility and Use of Service
911 Analytics is a fire department management platform offered to fire departments and emergency service organizations. You must be at least 18 years of age and an authorized member of a registered fire department to use the Service. By using the Service, you represent that you meet these requirements.
2. Operational Disclaimer
911 Analytics is an administrative and informational tool. It is not a primary dispatch system, an incident command system, or a personnel accountability system, and must not be relied upon as the sole source of truth during an active emergency response.
Features such as response declarations, apparatus status, kiosk check-ins, location reporting, dispatch alerts, and on-scene markers are provided for situational awareness and post-incident reporting. They supplement — but do not replace — your department's official dispatch protocols, on-scene accountability procedures, radio communications, and incident command system.
You are solely responsible for your department's dispatch and accountability procedures. We are not liable for any decision, action, or omission made in reliance on information displayed by the Service.
3. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to notify us immediately of any unauthorized use of your account or other security breach.
4. Acceptable Use
You agree not to:
- Share login credentials, or use another member's account.
- Use the Service for any purpose other than legitimate fire department management.
- Attempt to gain unauthorized access to data belonging to other departments.
- Reverse engineer, scrape, or interfere with the Service or its security.
- Upload content that is unlawful, harassing, or violates the rights of others.
5. Confidentiality of Department Data
Department data — including run reports, personnel records, response logs, training records, dispatch information, and uploaded media — is treated as confidential. Access is restricted to authorized members of the department that owns the data and to service providers engaged to operate the platform under appropriate confidentiality terms. We do not share, sell, or disclose department data to unaffiliated third parties.
6. Data Ownership and Export
Your department owns its data. We do not claim ownership of any data you enter into the Service. Upon request following cancellation, we will make a reasonable effort to provide an export of your department's data within ninety (90) days. After ninety (90) days, we may permanently delete your department's data and are under no obligation to retain or recover it.
7. Subscriptions, Billing, and Refunds
The Service is offered on an annual subscription basis with a recurring maintenance fee. Initial setup and training are included with your subscription. Specific pricing is provided in your department's order form or service agreement.
Free trial / refund window. New subscriptions include a thirty (30) day full-refund period. If you cancel within thirty (30) days of your initial subscription start date, you are entitled to a full refund of fees paid. After thirty (30) days, fees are non-refundable.
Renewal. Subscriptions automatically renew at the end of each term unless cancelled. We will provide reasonable advance notice of upcoming renewals and any pricing changes.
Cancellation. You may cancel at any time by contacting us. Cancellation takes effect at the end of your current billing period; you will retain access until that date. No partial-period refunds are issued except during the 30-day refund window described above.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted, error-free, or uninterruptible service. The Service may be temporarily unavailable due to maintenance, third-party outages, or events outside our control. As stated in Section 2, the Service must not be used as a primary dispatch or accountability system.
9. Modifications to the Service
We may add, change, or remove features at any time. Material changes that adversely affect your use will be communicated with reasonable notice when feasible.
10. Termination
We may suspend or terminate your access if you violate these Terms, fail to pay subscription fees, or use the Service in a way that creates legal or operational risk. Upon termination, the data export provisions of Section 6 apply.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, OR BE FREE OF ERRORS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAYLOR MADE DESIGNS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM SERVICE INTERRUPTIONS OR RELIANCE ON SERVICE OUTPUTS DURING AN EMERGENCY RESPONSE. OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOUR DEPARTMENT PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Taylor Made Designs, LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your or your members' use of the Service, your department's data or content, or your violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Spencer County, Indiana, and you consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to subscribed departments by email or through the Service. Continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes.
16. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. These Terms, together with any service agreement between your department and us, constitute the entire agreement between us regarding the Service.
